Service purchase and cancellation policy

  1. General terms

1.1. Service purchase and cancellation policy (below - Terms) provides for mutual rights, obligations and responsibilities from a person (below - the buyer) who purchases organized experience or services (below - the service) in the online store - on the website: https://www.pancars.eu (below - online store), from SIA UNICORN DIVISION, registration nr. 40203169165 (below - the seller) legal address: Kurbada Street 1a-22, Riga, LV-1009.

1.2. The service is started after full payment for the service and receipt of confirmation from the seller electronically to the e-mail specified by the buyer.

1.3. Participation in the service is the personal responsibility of each participant for any risks associated with the intended activities. The specific risks or concerns that participants have must be mentioned at the time of registration and discussed with the service provider individually.

  1. Purchase agreement

2.1. The distance agreement (below - the purchase agreement) between the buyer and the seller is concluded at the moment when the Buyer completes the order basket in the online store and pays for the purchase.

2.2. To complete the purchase, the buyer indicates the delivery address, selects the payment method and reads the Terms and confirms it with the "Buy" or "Pay" button. The purchase agreement is binding on the buyer and the seller throughout the provision of the service.

2.3. Each concluded service purchase agreement between the buyer and the seller is stored in the seller's database for 5 (five) years, or until the data processing purposes are achieved, or if the data can be used for other purposes - then for other purposes.

2.4. In case the Buyer does not agree with the Terms, the Buyer cancels the purchase and does not place the order.

  1. Rights and obligations of the buyer

3.1. The Buyer is bound by the Regulations and the regulatory enactments of the Republic of Latvia when purchasing the service in the online store;

3.2. The buyer makes a full payment using the chosen payment method at the time of purchase of the service. If the payment transaction is canceled after the purchase of the service, the purchase agreement is considered invalid.

3.3. Pircējam ir tiesības atteikties no iegādātā pakalpojuma Noteikumu 5.punktā noteiktajā kārtībā.

3.4. The buyer is fully responsible for his / her health when visiting the services. The buyer is obliged to assess the risks and, if necessary, consult his doctor or specialist.

  1. Rights and obligations of the seller

4.1. The seller has the right to unilaterally cancel the provision of the service 7 days before the specified date, if the minimum number of participants in the organized experience has not been reached. The seller informs the buyer about the cancellation of the service to the e-mail specified by the buyer. In case the service is canceled due to insufficient number of participants, the seller will refund the participation fee paid to the buyer of the service in full within 5 (five) working days.

4.2. The Seller has the right to restrict or suspend the right to use the Online Store without prior notice if the Buyer attempts to disrupt the operation of the Online Store or violates the Terms. The buyer shall be liable for the damages caused to the seller and shall reimburse them in full as a result of the above actions.

4.3. The Seller has the right to unilaterally amend the conditions specified in the Terms. The current version of the Regulations is posted on the website https://www.pancars.eu/. The changes take effect from the date of their publication and apply to all purchases made after the publication.

4.4. The seller is not responsible for any losses of the buyer due to the malfunction of the online store or errors in network data transmission.

4.5. In the event that due to circumstances beyond the control of the seller, the seller is unable to provide the service to the Buyer, the seller may offer an analogous service to the buyer. If the Buyer does not agree with the changes in the service, the seller will refund the full fee to the buyer within 5 (five) working days from the date of receipt of the buyer's refusal.

  1. Terms for refusal and return procedure

5.1. Veicot pirkumu interneta veikalā, pircējs var izmantot atteikuma tiesības. Atteikuma tiesības ir patērētāja tiesības noteiktā termiņā, nesniedzot nekādu pamatojumu, atkāpties no distances līguma (no distances līguma veidā pasūtītās preces vai pakalpojuma).

5.2. Atteikuma tiesības ir izmantojamas 14 dienu laikā no līguma noslēgšanas dienas par pakalpojumu sniegšanu.

5.3. Atteikuma tiesību izmantošana nozīmē “paziņošanu” par atteikšanos no pasūtījuma, proti, “paziņojuma par atteikumu” iesniegšanu vai nosūtīšanu pārdevējam uz e-pastu: pancars@pancars.eu

5.4. Pārdevējam, gadījumā, ja pircējs izsaka vēlmi par atteikšanos no pakalpojuma, ir jānosūta atteikuma veidlapa uz e-pastu: pancars@pancars.eu.

5.5. Ja pircējs izmanto atteikuma tiesības un tas nav saistīts ar attiecīgā pakalpojuma neatbilstību līguma noteikumiem, tad pircējs patstāvīgi sedz izmaksas, kas saistītas ar atteikumu no pakalpojuma.

5.6. Ja pircējs izmanto atteikuma tiesības, pārdevējs ne vēlāk kā 14 kalendāro dienu laikā no dienas, kad pircējs ir nosūtījis rakstisku atteikumu, atmaksā pircēja veiktās iemaksas.

5.7. Atteikuma tiesības attiecas uz pircēju, kurš saskaņā ar Patērētāju tiesību aizsardzības likumu var tikt atzīts par patērētāju. Patērētājs — fiziskā persona, kas izsaka vēlēšanos iegādāties, iegādājas, vai varētu iegādāties vai izmantot preci vai pakalpojumu nolūkam, kurš nav saistīts ar tās saimniecisko vai profesionālo darbību.
